In fact, Dumbledore states that "Black family tradition decreed that the 
house was handed down the direct line, to the next male with the name of 'Black'." 
Chap. 3, pg 50, Scholastic American Version.

So, if Regulus WAS still alive, Kreacher and the house could never have 
passed to Harry, despite Sirius' will.
