There was never a penalty mentioned for Draco if he failed in his task. 
It was just sort of assumed that if he failed he would wind up dead 
anyway. I think Voldemort would offer him status and honors for getting 
as close as he did and Draco would eat that up. He would become an 
enthusiastic DE.

So, in fact there was a penalty for Draco if he failed. Death penalty.
