First, Dumbledore did indeed believe that Sirius had betrayed Lily and 
James - he told the Ministry of Magic that the Potters had made Sirius 
their secret keeper.

Second, a godparent might have standing in a U.S. court. A child 
doesn't necessarily go to biological relatives. If the parents have a 
will, the court may respect their wishes and give the child to the 
person the parents designate. Also, anybody can sue for custody of a 
child --- if a godparent alleged that the aunt and uncle were abusive, 
for example, the court might place the child with the godparent.
