Basically, I agree, but Dobby could have been set up. Just like he 
was set up by Crouch/Moody, when he staged a conversation with 
McGonagall about jellyweed. But that would mean that Lucius is aware 
of his elf's delicate sensibilities and personal sympathies and that 
would be certainly out of character.
