It wasn't just Harry. It was all three of them (HRH):

"Before Snape could take even one step toward him, he [Harry} had
raised his wand.

"'*Expelliarmus!*' he yelled--except that his wasn't the only voice
that shouted. There was a blast that made the door rattle on its
hinges; Snape was lifted off his feet and blasted into the wall. . . .

"Harry looked around. Both Ron and Hermione had tried to disarm Snape
at exactly the same moment. . . .

"'We attacked a teacher. . . We attacked a teacher. . .' Hermione
whimpered, staring at the lifeless Snape with frightened eyes. 'Oh,
we're gong to be in so much trouble--'"(PoA Am. ed. 361-62).

So, yes, that's the passage I was referring to. It was all three, not
just Harry, who did it, and Snape tells Fudge that all three were
confunded (386). He could have had all three expelled, but instead he
covers up for them.
