Geoff:
As other posters have pointed out, magic is required to make a Horcrux - after all, as far 
as we know Voldemort has only created Horcruxes from a small numbers of his victims,

If Draco had killed Dumbledore and split his soul, the pieces would have remained within 
him unless he decided (or even knew) how to create a Horcrux. Why would that leave DEs 
as the only option? He could have continued living with the family and pursuing an interest 
in the dark arts without actually joining the "gang".
