Especially since the Ministry can bend the rules any time it likes.
Scrimgeour was all set to do it, too.

They do hire genuinely talented people now and then, if only by
accident :) But no matter how much JKR tortures Dolores, her kind
will continue to infest the Ministry, and what's Harry going to do 
about that?
