I think that after you murder someone, you then use
the spell to make a horcrux... this did not happen
with Harry, the murder failed! He (Harry) just had
powers tranferred from LV to him.

Another interesting thought, what if Harry must try 
to save both Ron and Hermione but only 1 can
survive...hate this thought!!!
