DD IS dead, I don't see why he shouldn't be. His role as a character was finished, Harry 
knows enough to be on his own now. DD poisoned himself with that potion (if LV did it, I 
don't see him as the type who would concot a harmless potion) for the good cause, and 
then asked Snape to kill him because he wanted to spare Draco from doing it.
Phoenixes do reborn, but rebirth can take different ways. And there is a portrait of DD at 
Hogwarts already...
