I agree with this. Way back in post 139859, in a long discussion on 
whether Harry was or was not a Horcrux - and I have always argued 
strongly in favour of the latter - I wrote the following:

Please note that Slughorn does not say that horcruxes are randomly 
created. They are created by an ACT OF EVIL. They do not just 
"happen" - they are made by a specific act of will.
