Absolutely, I think it is probably more fair to say that
Dumbledore belonged to Fawkes than to say Fawkes belonged
to Dumbledore. Fawkes seems to be an independant self-
determined creature. They are not captured, broken, and
trained like horses or dogs. From the description in 
'Fantastic Beasts and Where to Find Them', it seems that 
it is the choice of the Phoenix as to whether to attach 
itself to a wizard, and whether to continue to stay with
that wizard.

So, I don't think it is in anyone's power to leave Fawkes
to anyone else as if he were a possession. Fawkes will 
decide for him/herself who and when it will be loyal to 
someone.

Just my view.
