No, we don't. We know neither that Harry's death would be necessary
nor that it would be sufficient to dispose of a soul fragment embedded
in him or in his scar. And DD has already spoken on the danger of
making a horcrux out of something that is alive.

Well, I don't think that Voldemort knows that he is. I also don't
think that killing him would destroy the horcrux. Most ways of killing
someone leave a body. (this is also another reason to think that the
curse that rebounded on Voldemort was not the killing curse)
