Really?  Even if Sirius could have been proved innocent, he couldn't  protect 
himself from Bellatrix and her bunch, much less an infant with a  permanent 
target on his back.  He is impulsive, irrational, immature, and  flies off the 
handle at the slightest provocation.  He has no business  taking charge of 
Harry.   As far as DD knows, the magical world's  existence depends on the life 
of this infant.  The priority is to keep him  alive.  James and Lily are dead 
and their chosen guardian is the prime  suspect.  How do you expect him to do 
anything else?
