Who says Real!Moody can't resist the curse? Likely
in the time he is left alone, he does try to fight 
it, but he is still trapped in a trunk. Further, 
every time fake!Moody needs to talk to real!Moody,
he probably refreshes the Imperius Curse just to 
make sure. So, even if Moody has fought it, he then
meets a new force of control.

Also, yes, a fourth year was able to resist, but 
Moody tried it on every student in the school, and
out of them all, Harry was the only one that we
know of who was able to shake it off. It seems to
be a rare ability.
