Actually I think it might be a little like someone who has taken
driver's education, but never gotten their license actually driving a
car.  Or like someone whose license has been revoked still driving.
Against the law but they need to catch you.

Mr. Weasly did say in GOF that you needed to pass a test to get a
license, but the kids did take classes during the HBP.  So they do
know how to apparate, but Harry at least hasn't taken the test.
Since the trace is no longer on Harry, the ministry doesn't know he
is apparating.
