If Snape had wanted to accio it (and it was his book, so he would have a perfect right) would it have come to him? For that matter, presumably he could have accio'd it at any time if he had become suspicious of Harry's achievements and seen that the book was missing from the cupboard. Couldn't he?>>

  First of, it wasn’t Snape’s book. Even thought Snape had used it, the book belonged to the school (McGonagall says Harry and Ron can use the school books until their own books arrive). So it wouldn’t been his right to do so. I believe that book passed through many hands before reaching Harry’s.

  Second of, it wouldn’t help Snape’s case to accio the book seeing as he needed to get Harry with it. By merely summoning the book, he’d only have the book and not a link between the object and Harry. Therefore he wouldn't be able to prove that Harry was using that book to his advantage.

  But here’s an interesting question: had Snape summoned Harry’s potion book which book would fly into his hand: the one lying in the school library (seeing as Harry merely replaced the cover) or the one that had the HBP’s notes in it?
