No answer to your first question, but I'm betting Moody's cloaks are 
just normal ones, "a travelling cloak imbued with a Disillusionment 
Charm, or carrying a Bedazzling Hex, or else woven from Demiguise 
hair..." (DH CanEd pg 333)  Harry has the true cloak, "a cloak that 
really and truly renders the wearer completely invisible, and endures 
eternally, giving constant and impenetrable concealment, no matter 
what spells are cast at it." (DH CanEd pg 333)

IMO, Harry could be seen by Bagshot/Nagini because he was wearing the 
Horcrux at the time and Nagini's Voldi-bit connected with the bit in 
the Locket and the bit in Harry.
