How can it be made out that if Harry had killed Draco in the 
bathroom it would have been murder?  Draco had been attempting 
to cast an Unforgivable Curse, specifically Cruciatus. Harry's 
been Crucio-ed; he knows what it feels like. He also knows what 
can happen to people who get Crucio-ed often, as he's met Mr. & 
Mrs. Longbottom. At worst it would have been manslaughter.
