Thanks found it in my UKed (finally). Reading the text it seems he
found out about it in OotP before the MoM fiasco.
Pg 474 UKed Paperback:
"but he was not aware, for instance, that the diary had been
destroyed until he forced the truth out of Lucius Malfoy."
End quote from canon.
So I was definitely wrong thinking he would kill Lucius on the spot
and it sure adds to the revenge issue although not to the rate of
success such a plan would bring.
I think DD was told by Snape, if LV found out the previous year
before the MoM incident then Snape would indeed know this.
