Simon:
IMO I think you need a very powerful Magic object to make a 
Horcrux, also there might be a time limit to splitting the soul and
making the Horcrux. That is why the Aurors have not made them or do
not know about them. Even DD has problems with the theory (then
again he might just want to find out how much Tom knew).
