Battle of Hogwarts was a Crucio, in a situation where no one's life was 
on the line. Though Amycus did not know it, he was badly outgunned in 
that encounter. Harry acted, IMO, in a fit of anger, something I, 
anyway, can certainly relate to and understand, especially as that 
action was over and done with a moment later.

When Harry's life really was on the line...he used "Expelliarmus".
