I don't think he was counting odds, and I don't know if he thought it was possible thay Riddle would show remorse. When it comes down to it, Harry wouldn't want to kill anyone. He tried to kill Wormtail, but in the end, changed his mind. When Bella killed Sirius, Harry went after her, but didn't kill her either. Yes, he probably wanted to, but he didn't. It seems when it comes down to it, he would rather let them live, and be punished by the law then kill them. So when it came time to deal with Voldemort, I am not surprised he tried to give Voldy an out.
