Not only that, the Advance Guard used a number of spells in the house (Disillusionment Charm, Lumos, Scourgify, something to unlock Harry's door etc.), but I assumed that DD arranged this with the Ministry. It was like when the Weasleys came to pick Harry up in GoF - Arthur did magic, but Harry didn't get punished - obviously it was arranged officially that they would be coming. True, unlike GoF, in OotP DD was on bad terms with Fudge, but Harry needed to be transported to London, so it was a reasonable request, and Fudge didn't have a reason to refuse, I think. Especially if the Dursleys were not home. Maybe I'm wrong, but it's the only explanation I can think of :-).
