I am working from memory (of books)--but two thoughts.

Did the group ever determine if Frank's murder was the source for Horcrux!Nagini? If LV needed a murder to make a Horcrux, he would have had to wave the wand. In the graveyard, the murder was just to get rid of a complication.

If that idea doesn't work, here's another: At the beginning of the book,LV was in a chair in a room, facing an old Muggle. Although he didn't appear strong, I think he was up to the task. In the graveyard however, he exposed, and vulnerable and may not have been able to face a wizard.
