Do you really think that Dumbledore would have ever let the Sorting Hat out
of his sight? Moreover, if TMR had gotten ahold of it and made a Horcrux
(unlikely, as it seemed the diary was a "practice" horcrux and the only one
he made during school), I think DD would notice, or at least sense the Dark
Magic eminating from it. Also, you'd think that the Hat, if indeed a
Horcrux, would be affected by housing some of LV's "soul" - it'd probably
try and not sort the Mudbloods, for one, nor would it have helped Harry in
the CoS, for another.
