Theory on HBP

Both Colin and Justin, along with Hermione and Penelope Clearwater, 
were petrified by the basilisk. Tom Riddle explained later --

Thus, it seems that neither Colin or Justin are of wizardly stock (we 
know of course that Hermione is not - we know nothing of Penelope's 
parent, but this statement from Riddle would certainly seem to 
confirm that they are non-magical).

student)
