Fawkes IS in at least one of Dumbledore's "memories" in HBP. He is sitting
on his perch during the entire memory of Voldemort approaching DD about the
DADA position.

And Harry dived after Dumbledore through the shifting silver mass, landing in
the very office he had just left. There was Fawkes slumbering happily on his
perch, and there behind the desk was Dumbledore, who looked very similar to
the Dumbledore standing beside Harry, though both hands were whole and undamaged
and his face was, perhaps, a little less lined.
Fawkes was not in the orphanage memory because there was no need for him and
of course the other memories belonged to other people. DD and Harry were just
visiting there.
