Okay, someone help me out here and let me know if I see a biggy Flint?

In COS, Harry is taken to Filch's office; Peeves drops the cabinet which
takes Filch's attention; Filch then returns and I quote:

Filch was looking triumphant.

"That vanishing cabinet was extremely
valuable!" he was saying gleefully to Mrs. Norris. "We'll have
Peeves out this time, my sweet--"

Now, we know it was broken because of this:
Nearly Headless Nick came gliding out of a classroom. Behind him,
Harry could see the wreckage of a large black-and-gold cabinet
that appeared to have been dropped from a great height.

Okay, so it was broken.  However, in OOTP, we have what the Weasley twins
did with Montague:

"He never managed to get all the words out,"
said Fred, "due to the fact that we forced him
headfirst into that Vanishing Cabinet on the first floor."

I think that Flint was already pointed out.  But, now, in HBP, what do we
see?  A vanishing cabinet that obviously needs to be fixed, which Malfoy
accomplishes.  So, am I confused or what?

And, in line with this, going back to OOTP, it says:

"It's Professor Umbridge, sir--she needs your help," said Malfoy.
"They've found Montague, sir. He's turned up jammed inside a
toilet on the fourth floor."

Now, from HBP:
[Malfoy]:
"In Borgin and Burkes," said Malfoy,
"and they make a kind of passage between them. Montague told me
that when he was stuck in the
Hogwarts one, he was trapped in
limbo but sometimes he could hear what was going onat school, and sometimes
what was going on in the
shop, as if the cabinet was traveling between them, but
he couldn't make anyone hear him. ... In the
end, he managed to Apparate out, even though
he'd never passed his test. He nearly died
doing it. ..."

Uh--duh--You Can't Apparate On Hogwarts Grounds Or In The Castle...is that
not correct?  As Hermione keeps reminding us?

Except when arrangements are made for ap lessons.

Now, are we all confused?  Shall we mull this over with some butterbeer and
cauldron cakes?
