And Malfoy doesn't actually know the details of what went on the CoS. 
Just that Riddle's diary & the basilisk were defeated by Harry. He 
wouldn't have any way of knowing Fawkes's role in it. And thus, 
Voldemort doesn't have any way of knowing either.
