Maybe they were 1st year beaters.  Who knows, maybe the rule is that first 
years can play if they show extraordinary skill at a position.  George and 
Fred showed skill as beaters.  I can't remember but is Malfoy the only one 
to protest?  If so, he wouldn't really know the rule since he was a first 
year.  He just protested because he wasn't allowed to be on a team.  Just a 
thought.
