I agree, and I'll quickly add that the whole Buckbeak sub-plot is
another anti-death penalty metaphor. The whole process is rigged,
and Hagrid is Buckbeak's lawyer, so Buckbeak was doomed from the
beginning.
Also, one could argue that the soul sucking of Crouch in GoF is
another anti-death penalty metaphor, as it is clearly viewed as wrong
by Dumbledore, etc. Indeed, Dumbledore's objection is to the
finality of it, in other words, that Crouch can't give testimony.
Dumbledore doesn't object to the lack of due process by objecting
that Crouch didn't get a trial.
