Is it really anti-death penalty or is it pro-due process? I would be
shocked if at the end of this Voldermort is alive in Azcaban, being
guarded by the Dementor replacements. I think there is a strong
message from Black that he believes *everyone* is entitled to due
process. He doesn't like Crouch's decision to allow Aurors use the
unpardonable curses on DEs. Most of this stems from him being sent to
Azkaban without a trial I'm sure.
