I'm fairly sure that in one of the books (I don't have them to hand at the 
moment, so I can't check) the students are given their little 'reminder' 
slips that tell them not to do magic at home and one of the twins comments 
about always hoping that they'll forget to give them out, or words to that 
effect.

So the rule definitely exists now, but I think from the evidence Mellie 
pointed out that it's fair to assume the rule is a recent development.  
Perhaps the MoM are just a bit more lax about the rule with students they 
know to be from wizard families, as they have their qualified parents to 
supervise them.  Hence small children are able to ride toy broomsticks, Fred 
and George are able to fly the car/perform experiments for WWW/enchant 
Percy's HB badge etc etc.
