My "fun" speculation is that Voldy didn't give the diary to Lucius or 
tell him its function.  More likely than not, Lucius just went and 
gathered up all of You-Know-Who (YKW's)'s stuff after he died and 
hung on to it.  He probably didn't act until this point because he 
didn't know what it did.  Possibly, he didn't have an acute enough 
reason to do so until now either, when discrediting the Muggle 
Protection Act and Arthur Weasley -- as well as the increasingly 
Mudblood-friendly Hogwarts Headmaster was so imminent.
