Several interesting points are raised here concerning the trial of Barty Jr 
aside from the niceties of reasonable doubt.  

However, if Barty Jr was a DE should he not also bear the Dark Mark, which 
would have gone a long way to support Barty Sr hostility, although given 
maniacal rage of Sr, it is doubtful that lack of the DM would have had any 
impact either.
