Although I am also of the opinion that Harry will suffer some sort of moral descent at some point during the series (and hurt others in the process), I cannot imagine Harry actually letting Malfoy go to jail if he were innocent.  He might hum and haw about it for awhile, but even without Hermione's counsel, he would inevitably do the right thing.  It's just him.  I  mean, he spared the man who killed his parents and made his life miserable for 10 years.  I have a hard time believing that he wouldn't show the same mercy to a boy that -- although a major prick -- hasn't really done *much* lasting harm to him or his friends.  Of course, Draco and Co. have certainly made the trio's life a living teenage hell -- but sending them unjustly to Azkaban would be too petty for Harry, IMO.

But great theory.
