I doubt Sirius will be free until book 7. (provided he lives that
long) It's just a kind of a pattern; There is a talk with Dumbledore
at the end of the year; There is a new DADA teacher each year; And
Sirius will not be freed any time in the near future.
Sirius only broke out in PoA, and he spends a year after breaking out
saving Harry from Wormtail. This helps a bit with Sirius's problems,
but it helps with Wormtail's as well. (I'll be comparing them because
neither of them will be able to walk the streets freely until and
unless their side wins.)
Sirius has Crookshanks, Ron, Hermione, Harry, Dumbledore, Remus, and
Buckbeak. He might have been able to do some work towards clearing
his name while travelling all over England, but I doubt this.
Wormtail is searching for Voldemort. Sirius is further ahead, but it
won't be staying that way for long.
At the start of GoF, Wormtail has reunited with Voldemort. (He was
pretty quick in finding Voldemort-I wonder why? Is his speed
important?) Meanwhile, Sirius and Buckbeak are hiding in a tropical
place, and Sirius is probably doing some important work towards
proving his innocence. But when Harry's first letter reaches him, he
probably starts focusing more on problems with Voldemort.
I'm sure Sirius would have kept in touch with Dumbledore and Lupin,
and maybe one of them mentioned that they had noticed something
suspicious. Maybe he was just worried about Harry. But either way, he
decides to go north. We lose track for most of the book what happens,
besides the fact that Sirius comes north. We also lose track of
Wormtail and Voldemort's doings. Then, right before the first task,
Sirius resurfaces to give Harry advice. He breaks into a wizarding
house-not good, as this might be traced back to him. He's also being
searched for up north. However, coming back also gives him a chance
to get the Daily Prophet, as well as listen to some of Hogsmeade's
gossip, which may be important and is almost certainly enjoyable.
He's obviously near Hogwarts as well, which is also good.
Skip ahead to Chapter 32. Voldemort rises again, rallies the Death
Eaters to him, and Wormtail redeems himself to Voldemort. MAJOR step
forward for Wormtail, not to mention Voldemort and the Death Eaters.
Chapter 36 now. Sirius's existance is made known to Bill, Mrs.
Weasely, Snape, and possibly McGonagall and Pomfrey. This is 3-maybe
5-more people who know he's innocent. Well, technically Bill and Mrs.
Weasely don't know yet, but Ron is going to tell them, and maybe even
tell the whole Weasely family. Another victory. But this, and a lot
of Sirius's steps, is counteraffected by Fudge's falling out with
Dumbledore. When Sirius decides to make himself known and get a
trial, this is going to have a serious weighing on the outcome, even
if there is a new Minister. (And remember, Saint Lucius took Saint
Cornelius's place.)
All in all, Sirius has managed to gain the trust of several people
and a possible bias with the courts because of Fudge's reaction.
Wormtail has been reunited with the Dark Side, which, unfortunately,
has the upper hand right now.
So I doubt he'll be free in Book 5. Even if I'm wrong, he might take
a while to get sufficient money and housing to support Harry and
himself. Though, if we're lucky, he'll be able to stay with a member
of the order, or there will be apartments for those in the Order who
live far away from Hogwarts, but unless we get this loophole, Harry
will be living with the Dursleys for a while.
