Not quite.

Draco says: It's not my fault, the teachers all have
favorites, that Hermione Granger---

I'm not sure what I think Draco's grades are.

His father makes it sound as if they are really bad, but
maybe nothing but being first is good enough for him.
Draco doesn't sound too scared of his dad here, but more
like a little whiner, making excuses.

And he mentions favorites, making it sound like more than
"just" Hermione above him.
