If Ron's memory can be trusted, underage wizards are allowed to use 
magic in emergency. The situation during the QWC should qualify as 
such.

"...underage wizards are allowed to use magic if it's a real 
emergency, section nineteen or something of the Restriction of 
Thingy" (CoS, US paperback p. 69) 

BTW, isn't it a bit unusual for a 12-year-old to memorize something 
like that? This isn't the only time Ron recalls a decree or a case, 
but IIRC he's not particularly good at history. Odd.
