I think this depends on how the Ministry watches for violations of 
the Decree -- does it keep tabs on specific people, specific places, 
all places connected with the Wizarding world, or some combination 
of all these?  The Riddle House was a Muggle residence, Tom was not 
living there (he lived at the orphanage during the holidays), the 
Ministry may not have known anything at all about it.  So maybe they 
weren't monitoring for magic use.  Why monitor a Muggle house with 
no children in it?
