You're right -- they are not failing potions.  In fact, doesn't 
Umbridge comment that the class is very advanced for their level when 
she is sitting in on the class?  I can't find the quote right now to 
back it up but I am sure she said something along those lines.  

And yes, I too believe that Harry will take NEWT level potions with 
Snape as potions master.
