There is nothing to work around.  Wizards do not need to duel to kill 
each other... one can sneak up behind the other or take him or her by 
surprise.  More than this, wands battling in my mind means that 
both spells need to be cast at precisely the same moment.  Thus they 
meet in midair and the effect takes place.  There is also the 
possibility that one of the two might at some point need to use a 
wand not their own.
