I'm not sure I'm with you here. Harry's OWL grade will determine 
whether he is allowed to start the 2 year NEWT course which begins 
at the start of the 6th year. He has not got a year to improve his 
grade. It is possible that he could retake the OWL in an effort to 
push up the grade, but that would then mean delaying the start of 
his Potions NEWT course and prolonging his stay at school.

I like this idea, because it means JKR can allow Harry to continue 
with Potions with a lower level grade - because a new teacher could 
lower the bench mark down. This would seem more plausible than Harry 
suddenly becoming "Outstanding", and it would be better than 
Dumbledore having to override Snape to keep Harry in the class. Of 
course, that would probably be the end of Snape though!
