Because OWLS are entirely exam based, Snape could give Harry U or T 
all year long, but come the exam, Harry performs the test to an O 
standard.  I completely subscribe to the theory that Harry will get a 
HUGE shock when he opens his exam results and sees O's for Potions, 
DADA and Care of Magical Creatures, and E's for Transfiguration, 
Charms, Herbology.  The rest he'll get A's (Divination - how can you 
fail this, History of Magic - not the best circumstances for 
examining, Astrology - bit of a ruined exam, what with McGonagal 
being stunned in the middle of it!).
