There were people other than DEs and members of the order who sided 
with good or evil.  Minerva may not have been in order, but she was 
and still is an advocate of what is right.  Based on all we have come 
to know, we see that their are two people whom Dumbledore repeatedly 
trusts-Hagrid and Minerva.  Also, we know that in Dumbledore's 
absence at Hogwarts Minerva is his second in charge.  She had heard 
the news about the Potters and knew Dd would eventually bring the 
child to the Dursleys, so she got there first and waited and watched 
like an advance guard.  Dumbledore suspected things were going wrong, 
so once he heard the Potters were dead, he acted quickly and set it 
up so Harry could go to a safe haven. 

Why is her presence any harder to believe then the fact that Dd set 
up Arabella Figg as a next door neighbor to watch over Harry or that 
he has been watching him in many other ways since.  Again, he knew 
bad times were coming, so they were being cautious.  We also now know 
that he knew about the prophecy, so he was probably protecting 
Neville heavily, too.  

Also, I could be wrong, but I thought Legilimency (reading thoughts) 
required a closeness and/or eye contact with the subject.  It is only 
different in Harry's case with Voldemort because they are one and the 
same "being".
