I think the snake is Nagini from GoF and Voldemort is possessing it. 
Possibly he sent it through the pipes to get into the MoM without 
being detected. I think when Harry ends up along for the ride since 
the connection between them seems stronger when Voldemort gets 
emotional which he had to be at that time and Harry, when asleep, is 
most vunerable. Voldemort must have been sure he going to get the 
prophecy that night but didn't expect it to be guarded that way.
