The law may make a difference between magic for
schoolwork and just plain magic. And where does it say
Hermione does magic at home. In fact she says that she
made so little elf hats because she couldn't do magic
at home, but now that she was back at school she could
more faster because she was able to use magic. If
Harry were to say to the vanishing spell at home in
the muggle world he could be practicing his homework
and might get away with it. Puddings flying through
kitchens, people blowing up and patronus spells are
not exactly homework stuff. And in the second book if
it was only Petunia and co. the MOM wouldn't have
cared, it was because of the muggle guests that they
did.
This is my theory, homework related magic ok as long
as not done in front muggles who aren't aware of the
WW world.
