It wasn't theirs to destroy first of all since it belonged to the 
Ministry of Magic.

Voldemort probably did know that Harry was coming to London since we 
have seen that he is a skilled Legilmens and he can reach Harry's 
mind through the scar.

Did you bother reading the lengthy explaination from Lucius? Nobody, 
but Harry and Lord Thingy could grab the prophecy without getting 
cursed like what happened to Podmore and that other fellow in Mungos.

The whole point of Sirius's death was that it was unfair.
