Yes, I've thought about the Occlumency argument. It certainly has
merit. I guess the question is how does the Dark Lord know who is
who? My understanding of Occlumency and Legilimency is that the
legilimens gets impressions from the mind of the other, and if
talented can put those impressions together coherently. If
Occlumency is simply blocking those original impressions, then to
prevent LV from knowing your *identity*, you'd have to block
virtually everything. Wouldn't LV have noticed that? Or is he, as
author Bernice has hilariously written on the SnapeFF site "He Who
Cannot Think His Way Out Of A Soggy Bag Of Every Flavour Beans?"
I also found it interesting in the graveyard scene that each DE
seemed to have an "assigned spot" in the circle, and each knew
exactly where to go, even to the point of leaving spaces for the
dead/defected DEs. They didn't just Apparate in those spots
automatically (suggesting LV did not direct it--like some kind of DE
ballet, hee hee), they appeared all over and then walked to their
spots.
