Questions: Apparating and Dumbledore at the Hearing

I'm going through the book again (on CD) and I had two questions that I'd
like to bring up

1.  When Harry is at headquarters for the Order of the Phoenix, Fred and
George do a lot of showing off of their apparating skills.  One evening they
apparate into Harry and Ron's room and land on Ron's knees - they say that
apparating at night is harder.  WHY??

2.  When Dumbledore is at the hearing for Harry he does an amazing job of
setting up the argument that if the Dementors were NOT working for someone
other than the ministry THEN someone AT the ministry gave the order.  When I
first read this, I thought he was being VERY clever, but now, I'm wondering
if he KNEW that someone at the ministry gave the order and not Voldemort.
Any thoughts??
